Privacy policy

What we collect, why we collect it, and how to have it deleted. Written under Colombian law — Ley 1581 de 2012 and Decreto 1377 de 2013 — and covering this site and the email address on it.

Who is responsible for your data

Make It Happen is the data controller, the responsable del tratamiento, for every piece of personal data described on this page. Article 13 of Decreto 1377 de 2013 requires the controller’s identification to appear in the policy itself, so it is set out here rather than deferred to a proposal. None of them is optional, and none is withheld.

What we collect, and when

Two moments only. When you send the contact form we receive what you typed: name, email, company, current site if you gave one, your role, the services you selected, your timeline, the shape of engagement you picked, and the objective you described, together with the page you sent it from and the site that brought you. When you write to us by email we hold that message and our reply. Separately, the site measures visits: pages viewed, approximate region from your IP address, device and browser class. We ask for no identity document, no payment detail, and there is no account to create. We ask for no sensitive data either — nothing about health, biometrics, racial origin, political opinion, religious belief, union membership or sexual orientation, which Ley 1581 de 2012 defines as datos sensibles and which nobody is obliged to hand over. No field requests it, no answer depends on it, and the form is not addressed to children or adolescents. If something of that kind arrives anyway in the free-text box, we delete it from the record and make no use of it.

Why we collect it, and on what legal basis

To answer you, to prepare a quote, to keep a record of what was agreed, and to see which pages bring real requests. Under Ley 1581 de 2012 the basis is your prior, express and informed authorization, given when you tick the box and submit the form, or when you write to us. If the conversation becomes a contract, we also process what that contract and Colombian tax and commercial rules require. The form's contents are handled inside our own systems, including automated tooling under human review, to draft the reply. We do not sell your data, rent it, or add you to a list we sell.

Who else touches it

Three categories of processor, and no more: a hosting and database provider that stores the submission, an email delivery service that carries our reply, and — once you have accepted measurement — a web analytics service that records the visit. Each works under a contract that limits it to our instructions and forbids any use of its own — an encargado del tratamiento, in the language of the law. If an engagement starts, an invoicing and accounting service holds the billing record. We name categories rather than companies because the list changes; write to us and we will tell you exactly who is in it today. We hand data to an authority only on a valid legal order.

Data that leaves Colombia

It does. The providers above run their infrastructure outside the country, mainly in the United States and the European Union, so sending the form is an international transfer of your data. Ley 1581 de 2012 permits that transfer on one ground here: your express and unequivocal authorization, which is what the box on the form is for. Our contracts with those providers bind them to a standard of protection no lower than Colombian law requires of us — that is a safeguard we add, not a second legal basis. The authorization is the basis, and withdrawing it stops the transfer. If that is a problem for you, say so in your first email and we will tell you plainly what we can and cannot keep inside the country.

How long we keep it

A request that does not become an engagement, and the emails around it, are deleted twenty-four months after the last message. If we start work together, we keep what the relationship needs for as long as it lasts. Once it ends, we keep only the records that commercial and tax rules oblige us to keep — contracts, invoices, accounting entries — for the period those rules set, which in Colombia reaches ten years. Measurement data is kept in aggregate for no more than fourteen months. The database itself has a term of its own, the periodo de vigencia the law asks us to state: it runs while the studio operates and while at least one of the purposes above is still live, and when neither holds the database is closed and its records deleted, except those the law makes us keep. You can ask us to delete your data earlier and we will, with the same exception.

Your rights, and how to use them

Colombian law gives you the right to know what we hold (conocer), to update it (actualizar), to correct it (rectificar), to have it deleted (suprimir), and to withdraw the authorization you gave (revocar la autorización). You may also ask for proof of that authorization, ask what use we have made of your data, and access all of it free of charge. Write to hola@makeithappen.com.co from the address we hold, say which of those you want, and that is enough: no form, no notarized letter. A question we answer within ten business days, a complaint within fifteen, extendable as the law allows if we tell you why. If our answer does not satisfy you, the Superintendencia de Industria y Comercio hears the matter, and the law asks you to come to us first.

Cookies and measurement

This site sets no advertising cookies and builds no profile to sell to an ad platform. What it does is measure: pages viewed, where you arrived from, device and browser class, approximate region. None of it starts on its own. A notice asks on your first visit, and the measurement script is added to the page only if you accept — decline and nothing is loaded at all, rather than loaded and then ignored. Declining is a control with the same weight as accepting, sitting next to it, and the site stays fully usable either way: no page, no form and no answer is gated on saying yes. Your choice is remembered in your browser as a preference rather than sent back to us as a cookie, so clearing your browser data clears the choice and we ask again. What we cannot switch off are the requests your browser must make to load the page and the server log that records them: they hold an IP address briefly, for security, and are not used to follow you.

When this policy changes

The date at the top is the only version marker. If a change adds a purpose, a category of recipient, or a new transfer, Colombian law obliges us to ask for your authorization again before it applies to data we already hold, and we will ask by email, at the address we have. Smaller edits — clearer wording, a corrected contact detail — are published here with a new date and nothing else. We do not keep a public archive of old versions. If you need to know which text applied on a particular day, ask by email and we will send you that version.
